These Terms of Use ("Terms") constitute a legal agreement between you and Evie Digital Pty Ltd ("Company," "we," "us," or "our") governing your use of the Meditator mobile application (the "App").
By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. License Grant
1.1 Limited License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:
Download and install the App on devices you own or control
Use the App for your personal, non-commercial use
1.2 License Restrictions
You agree NOT to:
Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Remove or alter any copyright, trademark, or proprietary notices
Rent, lease, lend, sell, sublicense, or transfer the App
Use the App for any illegal or unauthorized purpose
Circumvent any technical limitations or security measures in the App
Use the App to create competing products or services
Access the App through automated means (bots, scrapers, etc.)
Share your subscription access with others
1.3 Apple App Store Terms
This license is also subject to Apple's Licensed Application End User License Agreement (EULA), available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/
In case of conflict between these Terms and Apple's EULA, Apple's EULA prevails.
2. Subscriptions and Payments
2.1 Subscription Plans
The App offers the following auto-renewable subscription tiers:
Flow Subscription
3 personalized meditation experiences per day
1 custom meditation creation per day
Full access to meditation library
Cross-device sync (iPhone & Apple Watch)
Available as monthly or annual subscription
Masterful (Pro) Subscription
10 personalized meditation experiences per day
5 custom meditation creations per day
Creator superpowers (linked sessions, multiple durations)
Discoverability boost for your creations
Full access to meditation library
Cross-device sync (iPhone & Apple Watch)
Available as monthly or annual subscription
2.2 Billing and Renewal
Subscriptions are billed through your Apple ID account
Payment is charged at confirmation of purchase
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
Your account will be charged for renewal within 24 hours prior to the end of the current period
The renewal cost will be clearly identified before you complete the purchase
Annual subscriptions renew at the annual rate; monthly subscriptions renew at the monthly rate
2.3 Managing Subscriptions
You can manage and cancel subscriptions by:
Opening iOS Settings
Tapping your name at the top
Selecting "Subscriptions"
Choosing "Meditator"
Selecting "Cancel Subscription"
Cancellation takes effect at the end of the current billing period. You will retain access until then.
2.4 Price Changes
We may change subscription prices at any time. Price changes for existing subscribers will:
Be communicated via in-app notification and/or email
Take effect at your next renewal date
Allow you to cancel before the new price applies
2.5 Refunds
Refunds are handled by Apple according to their refund policies. We do not process refunds directly.
To request a refund:
Sign in with your Apple ID
Select "Request a refund"
Follow the prompts
Refunds are granted at Apple's sole discretion and according to their terms.
2.6 Free Trials and Promotional Offers
We may offer free trials or promotional pricing for new subscribers:
Free trial duration will be clearly stated before sign-up
You will not be charged during the trial period
Cancel anytime during the trial to avoid charges
Upon trial expiration, your subscription automatically begins and you will be charged
Promotional offers are limited to one per user unless otherwise stated
Eligibility for trials may be restricted based on prior subscription history
2.7 Offer Codes and Redemption
You may redeem offer codes within the App:
Select "Redeem" in the subscription screen
Enter your code as provided
Offer code terms (duration, tier) vary by promotion
Offer codes are non-transferable and cannot be exchanged for cash
Only one offer code can be active at a time
3. Account and Profile
3.1 Account Creation
The App uses Firebase Authentication for user accounts
Initially, accounts are created anonymously
You may optionally link your account to email or other providers in future updates
You are responsible for maintaining the security of your account
3.2 Profile Information
You may provide personal information such as name, meditation intentions, and goals
You agree that the information you provide is accurate and up-to-date
We use this information to personalize your meditation experience

3.3 Account Termination
We reserve the right to suspend or terminate your account if:
You violate these Terms
You engage in fraudulent or illegal activity
You abuse the App or harm other users
You use the App in a way that causes harm to our systems
Upon termination:
Your access to the App will be revoked
Your subscription will be cancelled (subject to Apple's refund policy)
Your account data may be deleted
4. User-Generated Content
4.1 Your Content
The App allows you to create custom meditation experiences ("Your Content"). You retain ownership of Your Content.
4.2 License to Your Content
By creating and sharing content within the App, you grant us a worldwide, non-exclusive, royalty-free license to:
Store and display Your Content within the App
Distribute Your Content to other users (if you choose to share it publicly)
Use Your Content for App improvement and promotional purposes
Create derivative works for personalization (e.g., generating personalized audio from your scripts)
This license survives termination of your account for content that has been shared publicly.
4.3 Content Standards
You agree that Your Content will NOT:
Violate any laws or regulations
Infringe on intellectual property rights of others
Contain harmful, abusive, or offensive material
Promote violence, hate speech, or discrimination
Contain spam, advertising, or promotional material
Include personal information of others without consent
Impersonate any person or entity
4.4 Content Moderation
We reserve the right to:
Review Your Content for compliance with these Terms
Remove or disable access to any content that violates these Terms
Suspend or terminate accounts that repeatedly violate content standards
We are not obligated to monitor user content but reserve the right to do so.
5. HealthKit and Biometric Data
5.1 HealthKit Integration
The App integrates with Apple HealthKit to:
Read biometric data (heart rate, HRV, respiratory rate, SpO2)
Write workout session data to your Health app
Provide real-time biometric feedback during meditation
5.2 Health Data Permissions
You must explicitly grant HealthKit permissions for biometric features to work
You can revoke permissions at any time via iOS Settings > Privacy & Security > Health
Revoking permissions will limit biometric tracking features
HealthKit data remains under your control and is governed by Apple's privacy policies
5.3 Health Disclaimers
THE APP IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE.
The App is designed for general wellness and meditation purposes only
Biometric data and feedback are for informational purposes and should not be relied upon for medical decisions
Always consult a qualified healthcare professional for medical advice
Do not disregard professional medical advice or delay seeking it because of information from the App
In case of a medical emergency, call emergency services immediately
5.4 Assumption of Risk
You acknowledge and agree that:
Meditation and breathing exercises may not be suitable for everyone
You should consult a healthcare professional before starting any new wellness practice
You use the App's health features at your own risk
We are not responsible for any adverse health effects resulting from use of the App
6. AI-Generated Content and Conversational AI
6.1 AI Meditation Guidance
The App uses ElevenLabs conversational AI to provide real-time meditation guidance:
AI responses are generated in real-time based on your biometric data and session context
AI guidance is for wellness purposes only and is not medical advice
AI responses may occasionally be inaccurate, incomplete, or inappropriate
You should use your own judgment when following AI guidance
6.2 Personalized Content Generation
We use AI to generate personalized meditation scripts:
Scripts are based on your profile, preferences, and meditation history
Generated content is customized but may not always meet your expectations
We do not guarantee the accuracy or suitability of AI-generated content
You may provide feedback to improve personalization
6.3 Third-Party AI Services
AI features are provided by third-party services (ElevenLabs):
These services have their own terms and privacy policies
We are not responsible for the performance or reliability of third-party AI services
AI service interruptions may affect App functionality
7. Apple Music Integration
7.1 Music Playback
The App integrates with Apple Music via MusicKit:
An active Apple Music subscription is required for full music library access
Bundled offline tracks are available without an Apple Music subscription
Music playback is subject to Apple's terms and conditions
We do not control or guarantee availability of specific tracks
7.2 Music Licensing
All music content is licensed through Apple Music
You may not download, extract, or redistribute music from the App
Music is for personal use within the App only
8. Intellectual Property
8.1 Ownership
The App, including all content, features, functionality, design, graphics, code, and trademarks, is owned by Evie Digital Pty Ltd and is protected by:

Trademark laws
Patent laws
Trade secret laws
Other intellectual property laws
8.2 Trademarks
"Meditator," "Masterful," and associated logos are trademarks of Evie Digital Pty Ltd. You may not use our trademarks without our prior written consent.
8.3 Feedback
If you provide us with feedback, suggestions, or ideas about the App:
You grant us an unrestricted, perpetual, royalty-free license to use that feedback
We are not obligated to keep feedback confidential
We may implement or ignore feedback at our discretion
9. Disclaimers and Limitations of Liability
9.1 "As Is" Disclaimer
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or reliability of content
Uninterrupted or error-free operation
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVIE DIGITAL PTY LTD AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS SHALL NOT BE LIABLE FOR:
Any indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Personal injury or property damage
Damages resulting from unauthorized access to your account
Damages resulting from AI-generated content or guidance
Damages resulting from reliance on biometric data or health features
OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 AUD, WHICHEVER IS GREATER.
9.3 Jurisdictional Limitations
Some jurisdictions do not allow exclusion of certain warranties or limitations of liability. In such cases, the above limitations may not apply to you, and our liability will be limited to the maximum extent permitted by law.
10. Third-Party Services and Links

Apple Services (HealthKit, MusicKit, StoreKit)

These services are governed by their own terms and privacy policies. We are not responsible for third-party services.

11. Privacy

12. Updates and Changes to the App
12.1 App Updates
We may update the App to:
Add new features
Fix bugs and improve performance
Comply with legal requirements
Enhance security
You may need to update the App to continue using certain features. Some updates may be automatic.
12.2 Changes to Terms
We may modify these Terms at any time. When we do:

Impose usage limits on features
We will provide reasonable notice for material changes affecting your subscription benefits.
13. Termination
13.1 Termination by You
You may stop using the App at any time. To fully terminate:
Cancel your subscription via iOS Settings > Subscriptions
Delete your account in the App (Profile > Settings > Delete Account)
Uninstall the App from your devices
13.2 Termination by Us
We may suspend or terminate your access to the App immediately if:
You violate these Terms
You engage in fraudulent or abusive behavior
Required by law or government authority
We discontinue the App
13.3 Effect of Termination
Upon termination:
Your license to use the App ends immediately
Your subscription will be cancelled (subject to refund policies)
You must delete the App from your devices
Provisions that should survive termination (e.g., disclaimers, indemnification) remain in effect
14. Dispute Resolution and Governing Law
14.1 Governing Law
These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.
14.2 Dispute Resolution
Before filing a legal claim, you agree to:

You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions or class arbitrations.
14.5 Jurisdiction
If arbitration does not apply, you agree that any legal action must be brought in the courts of New South Wales, Australia, and you consent to the exclusive jurisdiction of those courts.
15. Indemnification
You agree to indemnify, defend, and hold harmless Evie Digital Pty Ltd, its affiliates, officers, employees, and partners from any claims, damages, losses, or expenses (including legal fees) arising from:
Your use of the App
Your violation of these Terms
Your violation of any third-party rights
Your Content or conduct within the App
Your violation of any laws or regulations
16. Apple-Specific Terms
16.1 Acknowledgment
You acknowledge that:
These Terms are between you and Evie Digital Pty Ltd, not Apple
Apple is not responsible for the App or its content
Apple has no obligation to provide support for the App
16.2 Third-Party Beneficiary
Apple is a third-party beneficiary of these Terms and may enforce them against you.
16.3 Product Claims
We, not Apple, are responsible for addressing any claims related to the App
In case of third-party intellectual property infringement claims, we, not Apple, are responsible for investigation and defense
16.4 Legal Compliance
You represent that:
You are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
You are not on any U.S. Government list of prohibited or restricted parties
17. Miscellaneous
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Evie Digital Pty Ltd regarding the App.
17.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
17.4 Assignment
You may not assign or transfer these Terms or your rights under them. We may assign these Terms without restriction.
17.5 Force Majeure
We are not liable for any failure to perform due to circumstances beyond our reasonable control (e.g., natural disasters, pandemics, government actions, network outages).
17.6 Export Compliance
You agree to comply with all applicable export and import laws and regulations when using the App.
